In pursuance of Section 6 of the Local Government (Collection of Rates) Act, 1924 , I, the Minister for Local Government and Public Health, after consultation with the Postmaster-General, and with the approval of the Minister for Finance, do by this my Order make the following rules and provide for and prescribe the forms, matters, and things hereinafter appearing with respect to the service of demands for and the payment and collection of poor rate through and by means of the Post Office :—

1. This Order may be cited as the Post Office (Collection of County Poor Rate) Order, 1924.

2. In this Order—

(1) the expression " the Minister " means the Minister for Local Government and Public Health ;

(2) the expression " county council " means and includes the council of a county other than a county borough, and any body, persons or person appointed to perform the duties of a county council under Section 12 of the Local Government (Temporary Provisions) Act, 1923 .

3. The Schedule to this Order shall be read and have effect as part of this Order.

4. This Order shall apply to the county councils of the counties of Kerry and Sligo and to the county councils of such other counties as the Minister shall by order direct, and shall be deemed to have come into operation as regards the said first-mentioned counties on the Twelfth day of April, 1924, respectively, and shall apply to the collection of the poor rate made by the said first-mentioned county councils for the service of the local financial year ending on the 31st day of March, 1925, or any previous local financial year, and as regards any other county council to the poor rate made or to be made for the service of the local financial year ending on the 31st day of March, 1926, or any previous local financial year, according as the Minister shall direct.

5. The Minister may from time to time assent to any departure from the provisions of this Order.

6. Notwithstanding anything in any enactment requiring a county council to collect and levy poor rate made by it through duly authorised collectors, demands for the payment of poor rate made by a county council to which this Order is applied may be served and such poor rate may be collected by means of receivable orders through and by means of the Post Office, and any such demand and receivable order shall be in the Form (No. 1) in the Schedule to this Order.

7. Any poor rate so demanded may be paid into any Post Office mentioned in the form of demand, and the Postmaster or other appropriate officer of any such Post Office is hereby required and authorised to receive and accept payment of the amount of the poor rate specified in the receivable order on production of the receivable order, and to give a receipt therefor to the person paying the same in the form attached thereto, and in no other form whatsoever, and subject to the provisions of sub-section (2) of Section 1 of the Local Government (Collection of Rates) Act, 1924 , the receipt so given shall be a good discharge to the person paying the rate.

8. The Postmaster of any Post Office into which a rate is paid under this Order shall on payment of the rate complete and retain the receivable order, and shall transmit not less often than once in every week to the Accountant, General Post Office, Dublin, all receivable orders in his possession, accompanied by a list duly completed in triplicate in the Form (No. 2) in the Schedule to this Order.

9. The Accountant to the General Post Office, Dublin, shall not less often than once in each week transmit to the secretary of the county council all receivable orders received by him as aforesaid from the Postmaster of any Post Office, accompanied by a list duly completed in the Form (No. 3) in the Schedule to this Order, and shall lodge to the credit of the county council the amount appearing to be due to the county council on foot of such receivable orders, and shall advise the treasurer to the county council accordingly.

10. A county council to which this Order applies shall pay to the Accountant, General Post Office, Dublin, on behalf of the Minister for Posts and Telegraphs, a poundage rate of threepence in the pound on all or any rates collected under this Order through the Post Office which have been duly lodged to the credit of the county council.

11. A county council shall not be entitled to recover from the Minister for Posts and Telegraphs or from any other officer of the Post Office any moneys paid on foot of rates into a post office under this Order, which have been lost or have not been accounted for otherwise than through the fraud or dishonesty of an officer of the Post Office.

12. The Public Bodies Order, 1904, shall be read with such modifications as shall be necessary to give effect to the provisions of this Order, or, in case of doubt, as shall be directed by the Minister.
