ORDER OF THE MINISTRY OF INDUSTRY AND COMMERCE, DATED 29th JUNE, 1923, MADE UNDER SECTION 118 OF THE COMPANIES (CONSOLIDATION) ACT, 1908, PRESCRIBING FORMS FOR THE PURPOSES OF THE COMPANIES ACTS, 1908 TO 1917.

Whereas by section 118 of the Companies (Consolidation) Act, 1908, it is provided that the forms set forth in the Third Schedule thereto, or forms as near thereto as circumstances permit, shall be used in all matters to which those forms refer, and that the Board of Trade may alter or add to the forms in the said Third Schedule ;
|

And whereas the functions of the Board of Trade in this behalf are now vested in the Ministry of Industry and Commerce ;
|
| |
And whereas it is expedient that certain forms prescribed by the Board of Trade under the said section 118 should be altered, and the forms hereinafter set forth be substituted therefor ;
|
| |
Now therefore the Ministry of Industry and Commerce do hereby prescribe and direct that the Forms hereinafter set forth shall be used for the purposes of the Companies Acts, 1908 to 1917.

Section 274 (3) of the Companies (Consolidation) Act, 1908, is as follows :—
|
| |
"(3) Every company to which this Section applies shall in every year file with
|
| |
" the registrar such a statement in the a form of a balance sheet as would, if it were
|
| |
" a company formed and registered under this Act and having a share capital, be
|
| |
" required under this Act to be included in the annual summary."
|
| |
The Statement above-mentioned is described in Section 26 (3) of the Act as follows :
|
| |
" Statement, made up to such date as may be specified in the Statement, in
|
| |
" the form of a balance sheet, audited by the Company's auditors, and containing
|
| |
" a summary of its share capital, its liabilities, and its assets, giving such
|
| |
" particulars as will disclose the general nature of those liabilities and assets,
|
| |
" and how the values of the fixed assets have been arrived at, but the balance
|
| |
" sheet need not include a statement of profit and loss."
